Terms of Use

These Terms of Use (“Terms”) apply to the Everwhisker app, everwhisker.com, Meowpage publishing in the app, meowpage.com, and related services that link to these Terms (together, the “Services”). By using the Services, you agree to these Terms. Our Privacy Policy explains how information is handled. If you do not agree, do not use the Services.

Everwhisker is an independently run personal hobby project, not a company. In these Terms, “Everwhisker,” “we,” “us,” and “our” refer to the project and its developer.

Terms from the marketplace where you obtained the app, or from another service you choose to use, may also apply. If the law gives you rights that cannot be waived, these Terms do not limit those rights.

You must be at least 13. If the law where you live requires you to be older to agree on your own, a parent or guardian must allow your use and accept these Terms for you. The Services are not intended for children under 13.

Everwhisker is a cat journal designed to keep private memories within the app on your device. Depending on your app version, it may include cat profiles, photos, stories, milestones, care details, keepsakes, backups, sharing tools, and controls for publishing selected information to Meowpage. Your phone’s own backup service may also keep a copy according to your settings.

Meowpage is Everwhisker’s public cat archive. Saving or previewing a Meowpage draft does not make it public. A profile appears on Meowpage only after you review the selected information and choose to publish it. Online features require an internet connection, and features may vary by app version, device, location, or marketplace.

Cat ID cards are created on your device. Their QR code contains only the text shown in the app; scanning it does not publish your journal or open an online Cat ID record.

While you follow these Terms, you may install and use the app and visit our websites for their intended purposes. You may not sell or rent the Services, copy or take apart our software except where the law allows, bypass safeguards, interfere with the Services, or use them commercially without our written permission.

You own the photos, stories, names, portraits, documents, and other material you add (“Your Content”). You are responsible for Your Content and must have permission to store, export, share, or publish it, including permission to share the name or image of any recognizable person.

Keeping material privately in the app does not give Everwhisker ownership of it. If you publish selected material to Meowpage, you give us only the permission described in section 7. You may continue using and sharing Your Content elsewhere.

You are responsible for protecting your device and making any backups you want to keep. Uninstalling the app, clearing its data, losing or damaging the device, or deleting an item may cause permanent data loss. Test important backups before relying on them. An Everwhisker backup can include journal text, original photos, drafts, care information, and attached documents. It is not protected by a separate backup password, so keep it somewhere private.

Creating or saving a Meowpage draft does not make it public. Before publishing, the app shows the selected cat details and optional owner details and asks you to confirm.

Control of a published profile is normally linked to the app installation that published it. Uninstalling the app, clearing its data, or changing devices may remove your ability to update or unpublish that profile. Unpublish first when possible, or contact us if you later need help with a profile you can no longer manage in the app.

When you choose to publish, you give Everwhisker permission to store, copy, resize, format, and publicly show only the material you selected, only as needed to provide and share that Meowpage. You can still use the same material elsewhere, and we do not owe a fee for displaying the page. We will not use it in unrelated advertising without separate permission.

This permission ends when the profile is unpublished or deleted, except for limited copies we may need to complete removal, protect the Services, settle a dispute, or follow the law. Our Privacy Policy explains retention. Copies already made by visitors or other websites remain outside our control.

Anyone may view, copy, save, or share a public page, and it may appear in search results. Do not publish home addresses, phone numbers, government-issued ID numbers, payment details, private health or care records, information about children, or another person’s name or photo without permission.

You must not use the Services to:

• break a law or infringe another person’s rights;
• share unlawful, deliberately false, threatening, hateful, exploitative, or sexually explicit material;
• pretend to be someone else or reveal private information without permission;
• send harmful software, bypass safeguards, interfere with the Services, or access something you are not allowed to access;
• use automated tools to collect information or place an unreasonable burden on the Services; or
• present a Cat ID or profile as official proof of ownership, identity, veterinary status, or registration.

We may remove or hide public content or limit online access when necessary to enforce these Terms, protect users or animals, respond to misuse, or follow the law. When appropriate, we will explain the decision and provide a way to ask for review.

Premium is currently offered as a one-time purchase, not a subscription. The price and included features are shown before you buy. The app marketplace handles payment, taxes, cancellation, and refund rules. When you open Premium, the app may contact the marketplace to show the current offer or restore an earlier purchase. We receive confirmation needed to unlock or restore Premium, but not your complete payment-card details.

The app keeps a purchase record on your device so Premium can remain unlocked. Deleting your journals does not cancel or remove the purchase. A purchase includes only what is described before checkout and does not include a separate online service unless the offer clearly says so. Nothing here limits refund or consumer rights that the law does not allow us to limit.

The project’s developer owns or has permission to use the app, visual designs, templates, text, brand names, logos, and other material supplied as part of the Services. The law protects those items. These Terms do not give you permission to use the Everwhisker or Meowpage branding outside ordinary use of the Services.

Feedback may be used to improve the Services without obligation to you, but it does not transfer ownership of Your Content.

If you choose to open or share material with another app, website, or service, its own terms and privacy policy apply to the copy it receives. We are not responsible for services we do not control. Companies we hire to help run the Services act on our instructions as described in our Privacy Policy.

We may update, add, remove, or stop features as Everwhisker changes. Features may not always work without interruption, suit every device, or remain available forever. If a change affects something you paid for, we will provide any notice, remedy, or refund required by law and by the terms shown before purchase.

You may stop using the Services at any time. Deleting the app or a local cat journal does not automatically remove a public Meowpage; unpublish that page separately first.

As far as the law allows, the Services are provided as they are and as available. We do not promise that they will always work without errors, meet every need, or work with every device. We do not take away any guarantee or other right that the law says you must have.

Everwhisker is a journal, not a veterinary, medical, emergency, animal-control, ownership-registration, or lost-pet recovery service. Care reminders and notes do not replace professional advice or emergency help. A Cat ID or Meowpage is not legal proof of identity, ownership, registration, or microchipping.

As far as the law allows, Everwhisker is not responsible for indirect losses, lost profits or business opportunities, lost data, or copies that other people make of material you publish or share. You remain responsible for deciding what to share and for keeping backups.

We do not limit responsibility that the law says cannot be limited. Some places do not allow certain limits, so those limits may not apply to you.

If you have a concern, please contact us first and give us a reasonable chance to resolve it. You may still use any court, regulator, or dispute process available to you under the law. These Terms do not take away mandatory consumer protections or any right to bring a claim in a place the law allows.

We may update these Terms when the Services or the law changes. The revised Terms will appear here with a new effective date. We will provide additional or advance notice when the law requires it. If the law requires us to ask for your agreement again, we will do so.
