Plain-language summary
Keep lawful content, protect your own backups, and share only material you have permission to use. Meowpage is not live yet, so nothing is published simply by creating a draft in the app.
Acceptance and scope
These Terms of Use (“Terms”) govern your use of the Everwhisker mobile application, everwhisker.com, and related services that link to these Terms (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services.
Additional platform terms from Apple, Google, or another service may also apply. If mandatory law gives you rights that cannot be waived, these Terms do not limit those rights.
Eligibility
You must be at least 13 years old and meet the minimum age to consent to digital services where you live. If you are below the age of legal majority, a parent or legal guardian must review and accept these Terms for you. The Services are not directed to children below the applicable minimum age.
The current service
Everwhisker is an offline-first cat journal with local profiles, memories, photos, milestones, care information, keepsakes, backups, and sharing tools. The website describes the product and planned Meowpage archive.
Meowpage publishing, online Cat ID lookup, user accounts, and cloud synchronization are not currently connected. Product previews and sample cats do not represent a promise that a future feature will launch in a particular form or on a particular date.
Permission to use Everwhisker
Subject to these Terms, Everwhisker grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app and access the website for their intended purposes. You may not sell, sublicense, rent, reverse engineer, interfere with, or commercially exploit the Services except where applicable law expressly permits it.
Your content
You retain ownership of the photos, stories, names, portraits, documents, and other material you create or add (“Your Content”). You are responsible for Your Content and for having the rights and permissions needed to store, export, share, or publish it, including permission from any identifiable person.
Local app use does not grant Everwhisker ownership of Your Content. A narrow service license for future online publishing is described separately below and applies only when you deliberately choose to publish.
Your device and backups
You are responsible for maintaining access to your device, protecting it with appropriate security, and creating backups you want to keep. Uninstalling the app, clearing its data, damaging or losing a device, or deleting a local item may cause permanent data loss. Test important backups and store them in a safe location.
Future Meowpage publishing
If public publishing launches, it will require a separate, affirmative publishing action. A local archive draft alone does not authorize publication. You will be shown the selected cat and owner fields before they are made public.
By choosing to publish, you would grant Everwhisker a worldwide, non-exclusive, royalty-free license to host, copy, resize, format, transmit, and publicly display only the selected content as needed to operate and promote that profile and the archive. You would retain ownership. The license would end when the profile is unpublished or deleted, subject to reasonable backup, legal, and technical retention and copies independently made by others.
Public material may be indexed by search engines or copied and reshared by other people. Do not publish private addresses, government identifiers, payment information, confidential care documents, or content you are not comfortable making public.
Acceptable use
You must not use the Services to:
- break a law or infringe another person’s rights;
- upload unlawful, deceptive, abusive, hateful, exploitative, or sexually explicit material;
- impersonate another person or disclose someone’s private information without permission;
- distribute malware, bypass security, disrupt service, or gain unauthorized access;
- scrape, harvest, or automate access in a way that burdens the Services or violates others’ privacy; or
- misuse a Cat ID or profile to falsely claim ownership, identity, veterinary status, or official registration.
If online features launch, we may remove content or restrict access when reasonably necessary to enforce these Terms, protect users or animals, or comply with law. Where appropriate, we will provide notice and a way to ask for review.
Purchases
Paid app features are offered through the applicable app store. Prices, taxes, payment processing, cancellations, and refunds are governed by the store’s terms and applicable law. A purchase does not include a future online service unless the offer expressly says so. We may verify an entitlement through the app store but do not receive your complete payment-card details.
Our intellectual property
The Services, software, visual designs, templates, text, trademarks, logos, and other materials supplied by Everwhisker are owned by or licensed to Everwhisker and are protected by applicable intellectual-property laws. These Terms do not grant permission to use the Everwhisker or Meowpage branding outside ordinary use of the Services.
Feedback may be used to improve the Services without obligation to you, but it does not transfer ownership of Your Content.
Third-party services
The Services may link to or interact with app stores, sharing destinations, device services, or websites operated by others. We do not control those services and are not responsible for their content, availability, privacy, or security. Your use of a third-party service is governed by its own terms.
Availability and changes
We may maintain, update, add, remove, or discontinue parts of the Services as the product evolves. We will avoid removing purchased functionality without a valid reason and will provide notice where law requires it. We do not promise that the Services will always be uninterrupted, error-free, compatible with every device, or available forever.
Important disclaimers
To the extent permitted by law, the Services are provided “as is” and “as available.” Everwhisker disclaims implied warranties that may lawfully be disclaimed, including merchantability, fitness for a particular purpose, and non-infringement. Nothing here excludes a warranty or consumer guarantee that cannot legally be excluded.
Everwhisker is a journal, not a veterinary, medical, emergency, animal-control, ownership-registration, or lost-pet recovery service. Care reminders, notes, Cat IDs, and public profiles are informational tools and do not replace professional advice, official records, microchipping, or emergency assistance.
Limits of liability
To the maximum extent permitted by law, Everwhisker will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost data, profits, goodwill, or business opportunity arising from use of or inability to use the Services. This limitation does not apply where prohibited by law, including liability that cannot lawfully be limited.
You remain responsible for independent backups and for deciding what to export, share, or publish. Some jurisdictions do not allow particular exclusions, so parts of this section may not apply to you.
Applicable law and disputes
Applicable law determines the law governing these Terms and the courts or processes available for a dispute. Nothing in these Terms removes mandatory protections or a right to bring a claim in a forum that applicable consumer law provides. Before filing a formal claim, please contact us and allow a reasonable opportunity to resolve the concern informally.
Changes and contact
We may revise these Terms as the Services or laws change. The revised Terms will appear here with a new “Last updated” date, and material changes will receive additional notice where required. Continued use after revised Terms take effect means you accept them, to the extent allowed by law.
